Announcement of No.17 2010 of General Administration of Customs on the Regulatio

To further regulate the import declaration for wine under tariff item of 22042100 in Customs Import and Export Tariffs of PRC 2010 and facilitate enterprises customs clearances and customs management, relevant matters are hereby announced as follows in accordance with Decree of the General Administration of Customs of the People's Republic of China on Import and Export Commodities Declaration (Announcement No.103 of General Administration of Customs):

First, imported commodity consignees and their agents shall strictly fill in the related documents based on Chinese Custom Export and Import Commodity Criterion Declaration Catalogue. and fill the product name and brand (both Chinese and English form) in the "commodity name" column according to the actual imported wine label, e.g. "干红葡萄酒,十字木桐古堡CHATEAU CROIX MOUTON" in "Product Name" column; fill the container's type, capacity, vintage and region of production of wine in "Specifications" column, for instance "BOTTLE 750ML,2004,BORDEAUX". If the wine label has the specified grades such as AOC、VDQS、VIN DE PAYS etc, they shall also be filled in this column.

Second, when the imported commodity consignees and their agents apply for imports, they shall submit the following materials to customs in addition to the current required documents and materials by customs.

(1) Color photograph or electronic photograph (not less than 3 million pixels) color prints of imported wine label (including the normal label and collating label) with complete content and clear text description.

(2) Original manufacturer's invoice. For the imports through outbound traders who can't offer the original manufacturer's invoice, the imported commodity consignees and their agents shall submit business invoice issued by outbound traders when apply for imports, and the invoice shall involve the manufacturer's name and the serial number of original manufacturer's invoice.

Third, the customs will deal with those who can't submit the aforementioned materials according to relevant regulation; for the declared content in the customs formality not matching the wine label content, the customs will deal with it for the reason of untruth declaration.

Fourth, this announcement shall come into effect on April 1st 2010.
