GACC Announcement 89, 2010 on Origin Rules under China-ASEAN Free Trade Area

Announcement No. 89, 2010 of the General Administration of Customs of the P. R. China (GACC)
After consultation through the 36th session of China-ASEAN Free Trade Area Trade Negotiations Committee, hereby announced below are the issues of applicability of the place-of-origin rules under China-ASEAN Free Trade Area:
1. As of January 1, 2011, with respect to goods exports in line with China-ASEAN Free Trade Area origin rules, the export consignors shall apply to relevant China's certifying authorities for relevant Certificates of Origin in the same format as the Annex 1 to the China-ASEAN Origin Regulatory Measures, which are below referred to as the New Certificates.
2. From January 1 till February 28, 2011, with respect to imports of goods under China-ASEAN Free Trade Area from Brunei Darussalam, the Lao People's Democratic Republic, Malaysia, the Republic of Singapore, the Kingdom of Thailand, and the Socialist Republic of Vietnam, the import consignees may, when declaring to the Customs, submit either the New Certificates or the Certificates of Origin in currently-used format (below referred to as the Old Certificates) both issued by certifying authorities of relevant countries within the six above-mentioned ones.
Where submitting the New Certificates, the consignees shall conform to the China-ASEAN Origin Regulatory Measures. And where submitting the Old Certificates, they shall conform to relevant regulations in GACC Announcement No. 81, 2003.
As from March 1, 2011, with respect to imports of goods in line with China-ASEAN Free Trade Area origin rules from any of the six above-mentioned countries, the import consignees shall declare to the Customs on the strength of the New Certificates issued by certifying authorities of relevant countries within the six above-mentioned ones, according to the China-ASEAN Origin Regulatory Measures.
3. Relevant regulations in the GACC Announcement No. 81, 2003 shall still apply to imports of goods under China-ASEAN Free Trade Area from four countries including the Republic of Indonesia, the Republic of the Philippines, the Kingdom of Cambodia, and the Union of Myanmar.
It is subject to later announcements for the China-ASEAN Origin Regulatory Measures to apply to the four above-mentioned countries as from a specific date.
