GACC Announcement 10, 2011 for Special Safeguard on NZ Agric. Products

Announcement No. 10, 2011 of the General Administration of Customs of China (GACC)

According to the New Zealand-China Free Trade Agreement and the GACC Announcement No. 91, 2008, China imposes special safeguard measures on agricultural products imported from New Zealand (NZ) under 11 HS Codes in four categories (hereinafter referred to as "agricultural products concerned"). Hereby announced are some matters on the special safeguard measures applied in 2011 to agricultural products concerned:

1. Import quantity of agricultural products concerned in 2010 respectively exceeded their quantity set as trigger level of special safeguard measures of 2010, and their imports en route therein are to be carried over to 2011 with corresponding reduction in their trigger levels of special safeguard of 2011.

The annex to this Announcement provides details of 2010's import quantity of agricultural products concerned for conventional tariffs and their 2011's actual import quantity for conventional tariffs while triggering the special safeguard.

2. Up to February 22 this year, regarding New Zealand-made non-concentrated milk and cream with fat content over 1% (HS Codes 04012000, 04013000), the declared imports have totaled 1,566.113 tons this year, and plus 198.529 tons imported en route last year, their aggregate has now outnumbered 1,505 tons that is 2011's trigger level of special safeguard measures.

Hence, as from February 26, 2011, the foregoing New Zealand-made products shall be subject to levy of import tariffs at the Most-Favored-Nation rates.

Application of tariff rates on en-route agricultural imports, and other relevant matters, may still be subject to regulations in the GACC Announcement No. 91, 2008.
