GACC Announcement 19, 2011 on China-ASEAN FTA Origin Rules

Announcement No. 19, 2011 of the General Administration of Customs of the P. R. China (GACC)
Implementation has been effective from January 1, 2011 upon the Administrative Measures of the Customs of the P. R. China on Origins of Import & Export Goods under China-ASEAN Comprehensive Economic Cooperation Framework Agreement (GACC Decree No. 199, hereinafter referred to as China-ASEAN Measures on Goods Origin).
Hereby announced below are matters on application of the origin rules under the China-ASEAN Free Trade Area (FTA):
1. Regarding export goods compliant with China-ASEAN FTA rules of origin, the consignors shall obtain in advance from China's certifying organs the Certificate of Origin in the format indicated by Annex 1 to the China-ASEAN Measures on Goods Origin (hereinafter called the New-version Certificate).
2. No later than June 30, 2011, regarding import goods from seven nations of Brunei Darussalam, Laos, Malaysia, Singapore, Thailand, Vietnam and the Philippines, the importers or their agents may go through import declarations to China Customs on the strength of the Certificate of Origin in the format indicated by the GACC Announcement No. 81, 2003 (hereinafter called the Old-version Certificate), or of the aforesaid New-version Certificate, respectively issued by certifying organs of these seven nations no later than March 1, 2011.
As from July 1, 2011, China-ASEAN FTA conventional tariffs may Not apply to imports declared on the strength of the Old-version Certificates issued by such seven nations.
3. Regarding import goods originating from three nations of Indonesia, Cambodia and Myanmar, the importers or their agents may still make declarations to China Customs based on the Old-version Certificates issued by certifying organs of these three nations.
Otherwise specified announcements shall be applied to specific dates of application by such three nations of the China-ASEAN Measures on Goods Origin.
4. This Announcement shall take effect upon its issuance along with simultaneous repeal of the GACC Announcement No. 89, 2010.
