GACC Announcement 50, 2011 for AD Duties on Non–Dispersion-Shifted SMF

Announcement No. 50, 2011 of the General Administration of Customs of China (GACC)

As per China's Anti-Dumping Regulations, the Customs Tariff Commission under China's State Council has decided to continue for five (5) years from January 1, 2011 the levy of anti-dumping (AD) duties on importing Non–Dispersion-Shifted Single-Mode Fibers (SMF) originating in Japan and/or South Korea, for which the GACC also issued its Announcement No. 91 in 2010.

Recently, upon application from relevant Chinese enterprises, China's Ministry of Commerce has ruled that South Korea's LS Cable & System Ltd. should carry on the anti-dumping duty rates and other rights or obligations applied to the country's LS Cable Ltd. pertaining to the SMF anti-dumping case.

Relevant matters as follows:

1. From August 5, 2011, China Customs may levy anti-dumping duties at the rate of 7% upon importing Non–Dispersion-Shifted Single-Mode Fibers (SMF) whose original maker is declared as South Korea's LS Cable & System Ltd.; meanwhile levy anti-dumping duties at 46% upon such fibers whose original maker is declared as South Korea's LS Cable Ltd. as "other South Korea's companies".

2. Regulations in relevant GACC announcements shall still be effective for any other matters with the anti-dumping measures herein.
