MOFCOM Announces Upcoming AD Expiry on Indian Sulfamethoxazole

On June 15, 2007, the Ministry of Commerce of China (MOFCOM) released its Announcement No. 48, 2007, deciding to impose antidumping (AD) duty on India-made sulfamethoxazole.

The antidumping measure is implemented from June 16, 2007 and will expire on June 16, 2012.

As per the Article 48 of the Anti-Dumping Regulations of the P. R. China, the antidumping measure can be prolonged once it is confirmed with review that its termination is likely to cause the continuation or reoccurrence of dumping and injury.

From the date of release of the Announcement, China's organizations or natural persons who represent China's local industries or legal persons may submit written applications for sunset review to the MOFCOM 60 days before the antidumping expiry.

The application should include clear expression for requesting the launch of sunset review and sufficient evidence to prove that the termination will likely cause continuation or reoccurrence of dumping and injury.

If Chinese organizations or individuals fail to submit their applications and the MOFCOM does not actively launch the final-review investigation before the expiry date, the antidumping measure will be terminated from June 16, 2012.
