GACC Announcement 80, 2011 on HS Code 9803 & Sub-Items Adjustment

In order to correctly implement the United Nations statistic norms on goods and service trades, hereby adjusted are the commodity descriptions and statistic scopes under Chinese HS Code 9803 and its sub-items listed in the China Customs Catalog of Commodities for Statistics:

1. As from 2012, the HS Code 98.03 and its sub-items therein shall be dedicated to the declaration of exporting software developed for specific demands of specific consumers; and non-customized exporting or importing software shall be classified and counted as carrier/media products.

2. The commodity description under the HS Code 98.03 is revised to "Customized software used with computers (only intended for exportation, but excluding the software consolidated or integrated with any products)";

The commodity description under the sub-item 9803.0010 is revised to "Customized system software (referring to the operating-system software that forms an operating environment or platform for any computer system or digital calculator and supports the operation of application software)";

The commodity description under the sub-item 9803.0020 is revised to "Customized bolstering software (referring to the software that provides auxiliary functions, such as application design and system test run, between an operating-system software and an application software)";

The commodity description under the sub-item 9803.0030 is revised to "Customized application software";

The commodity description under the sub-item 9803.0090 is revised to "Other customized software".

3. As from 2012, the HS Code 98.03 shall not be listed into the statistic scope of China's external trade in goods, and China Customs shall conduct separate statistics on this code.
