MOFCOM Announces Coming AD Expiry on Biphenol-A

Announcement No. 12, 2012 of the Ministry of Commerce of China (MOFCOM)

On August 29, 2007, China's Ministry of Commerce (MOFCOM) released its Announcement No. 68, 2007 deciding to impose antidumping (AD) duty on bisphenol A (BPA) originating in Japan, South Korea, Singapore and Chinese Taiwan. The antidumping measures took effect on August 30, 2007 and will expire on August 29, 2012.

Pursuant to the Article 48 of the Anti-Dumping Regulations of the People's Republic of China, where termination of the antidumping duties will likely cause continuation or recurrence of any dumping and injury, the antidumping duty may be extended appropriately.

From the date of this Announcement, China mainland's industries, or natural persons, legal persons and related organizations representing China mainland industries may submit written application to the MOFCOM for sunset review 60 days before the expiry date of the antidumping measures.

The written applications shall contain explicit expression about requesting the sunset review and sufficient evidence to prove that antidumping termination will cause continuation or recurrence of the dumping and injury.

If those industries or natural persons, legal persons and related organizations fail to submit the review applications, and the MOFCOM does not initiatively launch the sunset-review investigation before the expiry date of the antidumping, the antidumping measures herein will be terminated on August 30, 2012.
