MOFCOM Announcement No. 14, 2012 on AD Probe on EU Toluene Diisocynate

On February 3, 2012, China's Ministry of Commerce (MOFCOM) received the formal request by Cangzhou Dahua TDI Co.Ltd, Yinguang Group Gansu Yinguang Juyin Chemical Industry Co., Ltd, Gansu YinDa Chemical Co., Ltd, Liaoning Beifang Jinhua Polyurethane Corporation and Cangzhou Dahua Co., Ltd. Juhai Office representing China's toluene diisocynate industry for launching antidumping (AD) investigation into toluene diisocynate (model: TDI80/20) originating in the EU.

According to the Anti-Dumping Regulations of the People's Republic of China, the MOFOCOM investigated the qualification of the petitioners, the investigated import goods, Chinese-made counterparts, the effect of the investigated products on domestic industries, and the investigated origins.

Meanwhile, the MOFCOM examined the evidences about dumping, injury and causality between the dumping and the injury. The preliminary evidences offered by the petitioners showed that after excluding China's local manufacturers which are related to exporters or importers, the petitioners' TDI output in 2009, 2010 and 2011 accounted for more than 50% of China's total TDI output, compliant with the Articles 11, 13 and 17 of the Anti-Dumping Regulations of the P. R. of China; Additionally, the petitions contain the contents and evidences required for the anti-dumping investigation.

According to the examination results above and Article 16 of the Anti-Dumping Regulations, the MOFCOM decided to launch an antidumping investigation into the import toluene diisocynate (model: TDI80/20) originating in the EU from March 23, 2012.

Relevant matters are hereby announced:

1. Institution & Period of the Investigation

As from the issue date of this Announcement, the MOFCOM shall conduct the antidumping investigation into the toluene diisocynate (model: TDI80/20) originating in the EU.
The investigatory period for dumping is from January 1, 2011 to December 31, 2011, the investigatory period for injury is from January 1, 2008 to December 31, 2011.

2. Investigated Product & Scope

Investigation scope: toluene diisocynate (model: TDI80/20) originating in the EU

Investigated product name: toluene diisocyanate ("TDI" for short)

Model: TDI80/20

Molecular formula: C9H6N2O2

Physical & Chemical Feature: a kind of isocyanate under nitrogen compounds of organic chemistry, white or flavescent liquid under normal temperature, with pungent smell, miscible with acetone and ethers; easy to produce reaction with compounds containing active hydrogen, such as amine, water, alcohol, acid, and soda; easy to explode in hotness and fire.

Main Application: toluene diisocynate is the main raw material for manufacturing polyurethane products, such as foams, elastic body, coatings, and binders and so on, also used for surfacing of thin films of vinyl polymer, natural rubbers, chemical resistant additives of coatings, textile processing and so on, and also widely used in the fields of petroleum, chemical industry, mines, metallurgy, auto industry and railway transportation.

The product is under Chinese HS Code 29291010.

3. Registration of Response

Regarding the investigation for dumping, any interested party may apply for legal response to the MOFCOM's Bureau of Fair Trade for Imports & Exports within twenty (20) days from the issue date of this Announcement.

Any respondent exporter or producer shall provide the information of both their export quantity and export value of the investigated products to China during October 1, 2010-September 30, 2011.

The Referential Format of Registration of Response to Anti-Dumping Investigation is available for downloading from the "Announcements" on the MOFCOM's sub-website http://gpj.mofcom.gov.cn.

Regarding the investigation for industrial injury, any interested party may register for response with the MOFCOM's Bureau of Industry Injury Investigation within twenty (20) days from the issue date of this Announcement, meanwhile providing document describing their capacity, output, stock, construction or expansion projects and their relevant export quantity and value to China during the investigatory period for industrial injury.

The Form of Registration of Response to Industrial Injury Investigation is available for downloading from the response registration section of China's trade remedy information website (www.cacs.gov.cn).

4. Failure to Register

Where any interested party fails to register for response with the MOFCOM within the time limit provided herein, the MOFCOM shall have the power to reject any of his relevant submissions and to make a ruling based on any existing evidences.

5. Rights of the Interested Parties

Where any interested party has any objections concerning this investigation, it may submit its opinions in writing to the MOFCOM during the response registration aforesaid.

Any interested party may refer to the non-confidential copy of the written petitions submitted for the investigation at the MOFCOM's trade remedy information inquiry office (Tel: 86-10-65197878) during the response registration aforesaid.

6. Investigatory Mode

The investigator may conduct this investigation by means of questionnaire, sampling, hearing, onsite inspection, and so on into the interested parties.

7. This investigation shall start from March 23, 2012 and usually terminate by the end of March 23, 2013, and may extend to September 23, 2013 on special conditions.
