Announcement No.21, 2012 of the Ministry of Commerce of the People's Republic of China on Releasing the Preliminary Ruling on Anti-dumping Investigation on Imports of Certain High-performance Stainless Steel Seamless Tubes from the E.U. and Japan

According to the Regulations of the People's Republic of China on Anti-dumping, the Ministry of Commerce (hereinafter referred to as the "investigating authority") released an announcement on September 8, 2011 on its decision to launch an anti-dumping investigation against imports of certain high-performance stainless steel seamless tubes from the E.U. and Japan. Tariff No. of the investigated products are 3044110, 73044910, 73045110 and 73045910 under Import and Export Tariffs of the People's Republic of China.

The investigating authority has investigated into the existence of dumping and the dumping margin, the injury to China's certain high-performance stainless steel seamless tubes industry and its extent, and the causal link between the dumping and injury. According to the investigation result and Article 24 of the Regulations, the investigating authority has made a preliminary ruling, and announces the following:

I. Preliminary ruling

The investigating authority has made a preliminary ruling that dumping exist in imports of certain high-performance stainless steel seamless tubes from the E.U. and Japan during the period of investigation, and that there exists a causal link between dumping and the material injury.

II. The collection of deposits

According to Article 28 and Article 29 of the Regulations, the investigating authority decided to take provisional anti-dumping measures in the form of deposits. Importers of such products originated from the E.U. and Japan should place, starting from May 9, 2012, deposits at the Chinese Customs in accordance with the dumping margins of different companies as specified in the said ruling.

Tariff No. of the products subject to deposits are 73044110 and 73044910 under the Customs Tariff of Import and Export of the People's Republic of China.

Scope of Investigation: Imports of certain high-performance stainless steel seamless tubes from the E.U. and Japan

Salzgitter Mannesmann Stainless Tubes Italia s.r.l. 17.5%

ALL Others 37.5%

III. Calculation method of deposits

Importers of such products originated from the EU and the US should place, starting from January 25, 2011, deposits at the Chinese Customs in accordance with the dumping margin of the company as specified in the preliminary ruling. The deposits will be calculated based on the dutiable value determined by the Chinese Customs using the ad valorem method. The formula:Anti-dumping deposits = (dutiable value * rate of anti-dumping deposits)*(1+ import VAT rate)

IV. Comments
The interested parties may submit written comments, with supporting evidence, to the investigating authority for consideration within 20 days from the date on which this announcement is issued.
