MOFCOM Announcement No. 32, 2012 on Epichlorohydrin AD-Review Ruling

On June 28, 2006, the MOFCOM announced starting antidumping (AD) duties on epichlorohydrins (epoxy chloropropane) made in Russia, South Korea, Japan and the U.S. for five years from then on.

On June 27, 2011, the MOFCOM decided in its annual announcement no. 34 to conduct a final antidumping review on the aforesaid products under Chinese HS Code 29103000.

According to Article 50 of China's Antidumping Regulations and the decision of China's Customs Tariff Commission, relevant matters are hereby announced:

1. Ruling

The MOFCOM rules that terminating the antidumping measures would likely lead to continuation of the dumping and recurrence of the injury to Chinese industries by the epichlorohydrins (epoxy chloropropane) from Russia, South Korea, Japan and the U.S.

2. Antidumping Measures

From June 28, 2012, the antidumping duties shall be continued for five years in accordance with the scopes and rates specified in the MOFCOM Announcement No. 44 of 2006.

3. Levy Method

From June 28, 2012, the importers shall pay the antidumping duties to China Customs upon their imports of the products herein.

The antidumping duties are levied ad valorem on the basis of the customs-set duty-paid value by using the formula: antidumping duty amount = customs' duty-paid value × antidumping duty rate.

In addition, import value-added tax is levied ad valorem by using customs-set duty-paid value plus import duty and antidumping duty amounts.

4. Administrative Review & Lawsuit

According to Article 53 of China's Antidumping Regulations, where disagreeing on the antidumping review ruling, the interested parties may apply for an administrative review or file a lawsuit.

5. This Announcement takes effect from June 28, 2012.
