MOFCOM Announcement No. 36, 2012 on Filing for Anti-dumping Investigation Against Imports of Toluidine from the EU

The Ministry of Commerce of the People's Republic of China received, on May 2, 2012, a petition for anti-dumping investigation submitted by Jiangsu Huaihe Chemicals Co., Ltd, on behalf of domestic toluidine industry. The petitioner requests an investigation on anti-dumping against imports of toluidine from the EU.
In accordance with the Regulations on Anti-dumping of the People's Republic of China, the Ministry of Commerce made an examination on qualification of the petitioner, the subject imports, similar products in China, impact on the domestic industry of the product and regions involved. The Ministry of Commerce reviewed the evidence of dumping, injury and the causal link between dumping and injury provided by the petioner. the evidence provided initially by the petitioner suggests that, the aggregate toluidine output of the petioner, Jiangsu Huaihe Chemicals Co., Ltd. has a share of over 50% of the total output of similar products in Chinese mainland in 2008, 2009 and 2010. It meets requirement of Article 11, Article 13 and Article 17 of the Regulations on Anti-dumping of the People's Republic of China on petion for anti-dumping investigation by domestic industry. Meanwhile, the petition includes the contents and related evidence required for anti-dumping investigation by Article 14 and Article 15 of the Regulation on Anti-dumping of the People's Republic of China.
In line with examination made and Article 16 of the Regulations on Anti-dumping of the People's Republic of China, the Ministry of Commerce decided, on June 29, 2012 to initiate an anti-dumping investigation against imports of toluidine from the EU. And it is hereby announced as follows:

Coverage of investigation: imports of toluidine from the EU
Name of the imports under investigation: Toluidine
Molecular formula of the imports: C7H9N
Physical and chemical properties: it is colorless or yellow oily liquid or colorless flaky crystal, and can be soluble in ethanol, diethyl ether and diluted acids. There are three isomers, which are o-Toluidine, m-Toluidine and p-Toluidine.
Main usage: it is usually used as intermediate for dye, medicine and pesticide, and also for color developer. In the field of analytical chemistry, besides used as solvent, it can also be used as impregnation liquid for refraction index of minerals.
Tariff No. is 29214300 in Import and Export Tariff No. of the People's Republic of China. Except toluidine, any other goods under this No are not covered by the investigation.
III. Registration for responding
Any interested party responding to the anti-dumping investigation should, within 20 days from issuance of this announcement, register with the Bureau of Fair Trade for imports and Exports, Ministry of Commerce, and toluidine exporters or manufacturers registered for responding should provide to the Ministry of Commerce the volume and value of exports to China between January 1st, 2011 to December 31st, 2011. any interested party responding to the industry injury investigation should, within 20 days from issuance of this Announcement, register with the Bureau of Industry Injury Investigation, Ministry of Commerce, and provide to the Ministry of Commerce production capacity, output, inventory, plans for expansion and construction and the volume and value of exports to China. IV. Failure to register for responding
If any interested party fails to register for responding to the investigation within the time limit, the Ministry of Commerce have the right to reject relevant materials submitted by the party, and make a decision based on materials available.
V. Rights of interested parties
Any interested party may submit written comments to the Ministry of Commerce within the registration period, if it has objections regarding the coverage of this investigation, qualifications of the petitioner, country and other related issues.

VI. Method of investigation
Investigation authorities can adopt the methods of questionnaire, sampling, hearing or on-site verification to obtain information from interested parties.

VII. The investigation shall start on June 29, 2012, and to be completed by June 29, 2013. It may be extended to December 29, 2013 under special circumstances.
