GACC Announcement No. 37, 2012 for AD on Ethylene & Diethylene Glycol Monobutyl Ethers from U.S. & EU

According to China's Antidumping Regulations, the Ministry of Commerce of China (MOFCOM) has decided to conduct provisional antidumping (AD) measures from July 28, 2012 on Ethylene Glycol Monobutyl Ether and Diethylene Glycol Monobutyl Ether originating in the U.S. and the EU (see Annex 1), and relevant matters are hereby announced:

1. From July 28, 2012, upon the import goods aforesaid, China Customs may levy antidumping cash deposits and import value-added tax (VAT) cash deposits in addition to import duties and VATs by differentiating suppliers;

The cash deposits shall be calculated by using the following formulas at the rates specified in the Annex 2 herein:

Cash deposit total = (customs' duty-paid value × antidumping deposit rate) × (1 + import VAT rate)

The Annex 1 herein provides detailed description of the import goods.

2. The importers of these goods shall, in their declaration to the Customs, submit relevant Certificates of Origin and shall, regarding U.S. or EU origin, submit invoices of original manufacturers;

Where the Certificates of Origin are not available and the origin cannot be determined, the Customs may levy the antidumping cash deposits at the corresponding highest rate specified in the Annex 2 herein;

Where the origin is determined to be the U.S. or EU but the original manufacturers cannot be determined without their invoices, the Customs may levy the antidumping cash deposits at the corresponding rates applied to other companies from corresponding countries/regions listed in the Annex 2 herein.

3. Regarding the antidumping cash deposits levied on bonded imports by processing trade, the Customs may conduct according to GACC Decree No. 111 and GACC Announcement No. 9 of 2001.

4. Regarding the disposal of these cash deposits already levied, the GACC may conduct according to China's final ruling on this case.
