China Measures on Dairy Import-Export Inspection & Quarantine

China's Administrative Measures on the Inspection & Quarantine of Dairy Imports & Exports have been adopted by the General Administration of Quality Supervision, Inspection & Quarantine (AQSIQ) hereto and are hereby announced below.

These Administrative Measures shall enter into force on May 1, 2013.

Administrative Measures on the Inspection & Quarantine of Dairy Imports & Exports


Chapter 1 General Rules

Article 1 These Measures are formulated in accordance with China's food safety law/regulations, import-export inspection and quarantine law/regulations, entry-exit animal and plant quarantining law/regulations, State Council special regulations on product safety, and administrative regulations on dairy quality and safety.

Article 2 The dairy products herein include foremilk, raw milk, and milk products.

Article 3 The General Administration of Quality Supervision, Inspection & Quarantine hereto, or the AQSIQ for short, is in charge of nationwide supervision over the inspection and quarantine of dairy imports and exports.

Local entry-exit inspection and quarantine agencies, which are under the AQSIQ leadership, are responsible for local supervision, inspection and quarantine of dairy imports and exports.

Article 4 Operators of dairy imports and exports shall operate business by law and with responsibilities to the public.


Chapter 2 Dairy Import

Article 5 The AQSIQ may assess the food safety supervision and situation of foreign dairy exporting countries/regions and may conduct retroactive inspection of import dairy products.

As regards an exporter for the first time, its government agencies shall provide the AQSIQ with information concerning veterinary hygiene and public health regulations, responsible organizations, veterinary service system, health control system, residual monitoring system, animal disease monitoring system, and the export product categories.

The AQSIQ may define inspection and quarantine requirements for the acceptable products, including certificates required; Intergovernmental protocols may be formulated to confirm the inspection and quarantine requirements.

Article 6 The AQSIQ may keep registration of external dairy producers that export to China.

The external dairy producers shall guarantee the compliance of their products with China national standards on food safety and offer test reports that are required; upon their registration with the AQSIQ, they shall declare their dairy categories and brands to be exported to China.

The registered external producers shall be announced over the AQSIQ website.

Article 7 The dairy exports to China shall be provided with sanitary certificates issued by the government agencies of the exporting countries/regions, and the sanitary certificates shall certify that:

(1) The raw materials are derived from healthy animals;

(2) The dairy products are processed in proper manner and therefore devoid of animal disease;

(3) The dairy producers are supervised by local government agencies;

(4) The dairy products are safe for consumption.
