About Interpretation of Clauses in GACC Decree No. 200
In order to facilitate the goods trade early-harvest plan under the Mainland-Taiwan Economic Cooperation Framework Agreement (ECFA), the GACC hereby makes interpretation for "certifying documents issued by third-party customs" described in the Paragraph 2, Article 17 of China Customs Measures on Supervision of Origin of Import & Export Goods under the Mainland-Taiwan ECFA (in GACC Decree No. 200) regarding the transit of the ECFA covered goods via Hong Kong and Macao regions:
Where the ECFA covered goods are transited via Hong Kong and Macao, the "third-party customs" shall be Hong Kong customs and Macao customs, and the "certifying documents" shall be the Hong Kong Customs Confirmation and the Macao Customs Confirmation that are issued by the authorities respectively.
As regards the airborne transit at Hong Kong and Macao without transfer to new means of transport, i.e. only by original airplane, relevant certifying documents may be uniformly delivered by Hong Kong or Macao customs to mainland customs based on their agreement in advance.
Upon their customs declaration, the mainland importers may dispense with separate submission of Hong Kong Customs Confirmation and/or Macao Customs Confirmation, but shall provide certificates on carriers to certify that the air transit is by original airplane only and also shall declare any change in the flight number.
