MOFCOM Announcement No.56, 2013 on Perdue Farms Incorporated & Perdue Foods LLC

On August 29, 2010, China Ministry of Commerce (MOFCOM) decided in its annual Announcement No.52 to impose anti-subsidy measures on white feather broilers from the USA, with the anti-subsidy duty levied at 7.4% on Perdue Farms Incorporated;

On September 26, 2010, the MOFCOM decided in its annual Announcement No.51 to impose antidumping measures on the white feather broilers from the USA, with the antidumping duty levied at 51.8% on Perdue Farms Incorporated.

On June 3, 2013, by submitting the required documents, Perdue Foods LLC applied in writing to the MOFCOM for its inheritance of the rights and obligations of former Perdue Farms Incorporated regarding the Chinese antidumping and anti-subsidy measures herein.

Based on its investigation into the two enterprises, the MOFCOM hereby makes the decision:

1. Perdue Foods LLC is permitted to inherit the rights and obligations of former Perdue Farms Incorporated as regards the Chinese antidumping and anti-subsidy measures on USA white-feather broilers, including the payment of the antidumping duty at 51.8% and the anti-subsidy duty at 7.4%.

2. The investigated exports to China in the name of Perdue Farms Incorporated shall be subjected to the antidumping duty rate of 105.4% and the anti-subsidy duty rate of 30.3% that are applicable to other USA companies under the antidumping and anti-subsidy measures herein.

This Announcement shall enter into force as of August 27, 2013.
