GACC Announcement No.58, 2013 on Regional Customs-Clearance Reform

In order to implement state regional development strategy with the integration of regional customs clearance practices, the General Administration of Customs hereby decides to make further efforts to reform regional customs clearance practices as follow:

1. Expansion of the "local declaration and port release" mode

(1) As from November 1, 2013, the customs shall conduct the style of "local declaration and local release".

The style of "local declaration and local release", belonging to the "local declaration and port release" mode, means that export/import consignors/consignees of AA grade with customs brokers of not lower than B grade (hereinafter as "AA-grade enterprises") may choose at will local customs authorities for export/import declaration and release.

(2) The "local declaration and local release" mode is not applicable to the export/import goods that are to inspect, or required to declare and release at port-based customs, or whose export arrival report and import tally report cannot be electronically transmitted to port-based customs.

The "import/export licenses" do not include the "inspection certificates for entry/exit goods".

(3) Where the AA-grade enterprises are investigated for smuggling, infringement or other violations, they shall be suspended from the instituting date from the "local declaration and local release" mode.

(4) The customs supervision zones at a port, if being electronically connected with the customs authority, may permit pickup of goods on the strength of the electronic releasing instruction by port customs; if not electronically connected with the customs, the supervision zones may permit pickup of goods on the strength of paper certificate stamped by port customs.

2. Expanded application of the "local declaration and port release" mode

(1) As from November 1, 2013, such mode may be applied to the import clearance for B-grade manufacturing-based exporters without violation record for one year; from March 1, 2014, such mode may be applied to import and export clearance for B-grade manufacturing-based enterprises without violation record for one year.

(2) Such mode is not applicable to the export/import goods that are required to declare and release at port-based customs.

The "import/export licenses" do not include the "inspection certificates for entry/exit goods".

(3) The B-grade manufacturers described herein refer to the manufacturing-based enterprises under the B-grade supervision identified by the customs.

3. Responsibilities of the enterprises to adopt the "local declaration and port release" mode

(1) The candidate enterprises shall apply in writing to local customs for the adoption (see Annex 1 & 2); local customs shall conduct inspection of the applicants as per enterprise rating norms and then shall offer written reply of permission or disapproval (see Annex 3).

(2) The permitted enterprises to adopt such mode shall enter into Memorandum of Understanding with local customs authorities (see Annex 4).

4. Paperless operation of customs transfer by highway

The customs will utilize electronic information technologies to receive, examine, release and cancel the enterprises’ declarations for customs transfer and cargo manifests submitted electronically without paper.

As from December 1, 2013, the "paperless operation of customs transfer by highway" may be applied to the import/export goods to transfer among customs by domestic highways with their entry-exit transport by sea, air, rail and road, on the basis of using internet-of-things equipment, bayonet control and web-based information systems.

5. Expanded application of the "cross-border expedited customs clearance" mode

As from May 1, 2014, the "cross-border expedited customs clearance" mode may be expanded to all first-tier customs within Guangdong Province on the basis of using highway manifests.

6. This Announcement shall enter into force on its issue date of October 30, 2013.
