GACC Announcement No.22, 2014 on ECFA Customs-Declarations Filling Requirements for Mainland-Taiwan Trade

To facilitate the goods trade under China mainland-Taiwan Economic Cooperation Framework Agreement (ECFA), the cross-straits customs electronic information exchange system is to be launched online on April 1, 2014 to real-time transmit the goods origin data examined by the export-side customs.

Hereby announced are the requirements on the filling of import and export declarations following the launch of the system:

1. From April 1, 2014, the importers shall fill out their import goods declarations in accordance with the following requirements:

Fill with "Y"in the "attached certificate code"field of "attached certificate"column; fill in the "attached certificate number"field with "<14>"and "the Origin Certificate number”.

Fill in the "Documents Correspondence Table"with the corresponding relations between the import declarations-listed goods and the Origin Certificates-specified goods.

The serial numbers of the declarations-listed goods shall be one-to-one corresponding to the item numbers of the Origin Certificates, without the need of correspondence in sequence.

The goods under one batch, whether or not being covered by the ECFA conventional tariff, may be declared within the same forms.

As regards the goods without the ECFA conventional tariff, their serial numbers may not be provided in the "Documents Correspondence Table"which is exemplified in the Annex hereto.

2. From April 1, 2014, as regards the import goods whose electronic data of origin certificate are not received by the customs, when the importers declare to the customs, the declaration pre-entering client-side will prompt the unavailability of electronic information of origin certificates.

During the period of April 1-June 30, 2014, the importers may ignore the prompt of such unavailability and continue to declare their imports;

From July 1, 2014, as regards the prompt of such unavailability, the importers shall give explanations and apply for relevant guarantee-based clearance.

3. From April 1, 2014, as regards the export goods declared upon the Origin Certificates that are networked with the customs, the exporters shall fill out their export goods declarations in accordance with Article 1 aforesaid.

From June 2, 2014, the origin-certificate pre-entering system will be launched online. As regards the export goods whose Origin Certificates are not networked with the customs, the exporters shall in advance enter the certificate electronic information into the certificate system and then fill out their export declarations as per Article 1 aforesaid.

The export goods under the same Origin Certificate shall be declared with the same declaration form.

4. Where the exporters fail to provide origin information as required hereby, the exporters may apply for revision of their declaration forms to fill with accurate origin information.

As regards revision of origin certificates after the export of goods, the exporters may inform the customs after the certifying agencies re-issue the origin certificates; where the export declarations need to be revised owing to modification of origin certificate information, the exporters may apply for revision of their declaration forms.

As regards the export goods declared upon non-networked origin certificates, the exporters shall supplement or revise their origin-certificate electronic information through the certificate system before applying for their declaration revisions.
