GACC Announcement No.70, 2014 on Inbound & Outbound Transport and Manifest Supervisions

The General Administration of Customs of China (GACC) hereby announces the matters concerning the supervisions over inbound and outbound means of transport and over cargo/article manifests:

1. Enterprises shall, within prescribed time limit, accurately transmit to the Customs electronic manifest data of inbound and outbound transport and of the goods/articles carried therein in accordance with relevant filling specifications (see the annexes 1-5 hereto).

2. If the manifest transmitter self-finds data error in transmission, he may re-transmit the electronic data before the deadline of transmission regarding an original manifest and a pre-prepared manifest, but except the situation where a goods/article owner has finished customs declaration formalities.

3. An enterprise shall, before the shipment of its import or export goods, prepare paper-made or electronic version of its overall or separate bills of lading and shall transmit all the electronic data to China Customs within a time limit, including the electronic data of separate bills of lading; if there is no separate bills, the manifest transmitter shall provide the information of all goods/articles under an overall bill of lading through the manifest management system's "commodity description" data entry and then transmit to the Customs.

4. A customs declarer shall ensure that each declaration form has one corresponding bill of lading. Where one batch of goods/articles cannot be cleared in one declaration form, the declarer may apply to onsite customs unit for splitting the overall bill of lading of the goods/articles.

5. The transmitter shall strictly abide by the transmission time limits set forth in GACC Decrees No.172 and No.196. An applicant for the transmission shall abide by the time limits set forth in the Annex 6 hereto. In case of divergence of the time limits, this Announcement shall prevail over previous announcements.

6. As regards exporting non-containerized goods based on weight certificate, the goods handler shall transmit electronic data of goods handling report to the Customs on the strength of the weight certificates issued by state-authorized inspection agencies.

7. The manifest transmitter shall transmit the electronic data regarding allocation of inbound and outbound empty containers; where the empty containers are not actually loaded/unloaded as per the transmitted data, the transmitter shall undertake alteration of those electronic data with the Customs.

8. A land agency for inbound and outbound aircrafts shall be registered with the Customs (see Annex 7 hereto).

9. Where a registered enterprise has alteration in its registered information, the enterprise shall, within 10 workdays after its alteration in registered information, undertake the customs formalities for the alteration by submitting the Registration Alteration Sheet (see the Annex 7 to GACC Announcement No.79 of 2010).

10. Where an enterprise fails to transmit the electronic data of vehicles and manifests, the Customs will impose penalty on it in accordance with China Customs Regulations on Administrative Penalty.

11. The Customs will conduct field inspection over inbound and outbound vehicles and over the goods/articles carried therein. The enterprises involved shall cooperate with customs inspections in accordance with China Customs Law and regulations.

12. The transmitter may transmit the data over China E-Port platform. The Customs will not collect fees from their receipt of the data transmission and from modification of the manifest data with customs units.

13. This Announcement shall enter into force on October 15, 2014.
