MOFCOM Announcement No. 92, 2014 (on Wool & Wool Top Import Tariff Quotas for New Zealand in 2015)

In accordance with China-New Zealand Free Trade Agreement (FTA), the import tariff quotas in 2015 for wools and wool tops from New Zealand (hereinafter as New Zealand-oriented quotas) are 33502 tons and 603 tons respectively, both of which are cleaned/official quantities.
Relevant Matters are hereby announced:
1. The New Zealand-oriented quotas will be allocated on the strength of contracts in a "first come, first served"manner. The applicants shall submit applications for the quotas herein (processing trade included) to MOFCOM-authorized local administrations on the strength of import contracts and other documents.
The Application Form for New Zealand-oriented Tariff Quotas on Wool & Wool Top Imports is downloadable from (http://www.mofcom.gov.cn). The Country of Origin in the Application Form shall be noted as New Zealand only.
2. By September 30, 2015, the New Zealand-oriented quotas shall be applied as below:
Regarding wools, the aggregate quota quantity applied by an applicant with actual import performance (holding 2014's tariff quota) shall not exceed the import quantity within the tariff quota under the same mode of trade in 2014.
Regarding wool tops, an applicant with actual quota import performance in 2014 or a newly-built enterprise with annual processing capacity of 5,000 and more tons may apply for the New Zealand-oriented tariff quota at most for 50 tons of wool tops.
When the issued quotas add up to the total for 2015, MOFCOM-authorized administrations will stop receiving the applications.
3. After September 30, 2015, if the New Zealand-oriented tariff quotas are not used up, the applicants with actual import performances as aforesaid, after finishing their import quantity as stipulated in Article 2, may continue to apply for the remaining quotas upon MOFCOM approval. An applicant having 2014's global tariff quota import performance while not having the New Zealand-oriented quota, or a newly-built enterprise with annual processing capacity of 5,000 and more tons, may apply for the New Zealand-oriented quota upon MOFCOM approval.
4. The New Zealand-oriented quota will be demonstrated by Agricultural Import Tariff Quota Certificate, with remark as "Quota for New Zealand Wool and Wool Top Only"and quantity noted as cleaned/official quantity.
5. Upon customs declaration for the imports, a quota holder shall declare the cleaned/official quantities and submit relevant Agricultural Import Tariff Quota Certificate. After examination by the Customs, compliant importers will be provided with the China-New Zealand FTA conventional duty rates and incompliant importers may be subjected to China's most-favored-nation duty rates or general duty rates.
6. The quota application conditions and procedures, and quota certificate validity, extension, return and write-off, as well as relevant penalty rules, will all be subjected to the Implementing Rules On Administration Of Wool & Wool Top Import Tariff Quotas For 2015 (issued in MOFCOM Announcement No.65 of 2014).
