MOFCOM Announcement No.4,2015 (on Two-Anti Measures to Expire in 2015)

In accordance with Article 48 of China's Antidumping Regulations, antidumping levy and price undertaking are both limited to five or less years for performance; however the antidumping levy may be prolonged if a revocation would lead to continuation or recurrence of dumping and injury. Similarly, in accordance with Article 47 of China's Anti-Subsidy Regulations, the anti-subsidy levy and price undertaking are both limited to five or less years for performance; however the anti-subsidy levy may be prolonged if a revocation would lead to continuation or recurrence of subsidy and injury. In order for the interested parties to know the antidumping and anti-subsidy expiring dates, hereby announced are the two-anti measures to expire in 2015:

1. On July 30, 2014, MOFCOM Announcement No.50 of 2014 revealed that the antidumping on import phenol from Japan, South Korea, USA and Taiwan will expire on January 30, 2015.
On October 10, 2014, MOFCOM Announcement No.67 of 2014 revealed that the antidumping on oriented electrical steels from USA and Russia will expire on April 10, 2015 along with the anti-subsidy on those from USA.

On October 21, 2014, MOFCOM Announcement No.64 of 2014 revealed that the antidumping on Polyamide-6 granula from USA, EU, Russia and Taiwan will expire on April 21, 2015.

Besides, other two-anti measures to expire in 2015 are listed below (see Annex), without separate announcements by the MOFCOM in future.

2. Sixty days before the expiry of two-anti measures listed herein, domestic industrial representatives (individuals or organizations) may apply in writing to the MOFCOM for separate expiry reviews.

3. A written application shall contain clear request for an expiry review and adequate evidence that a revocation would lead to continuation or recurrence of dumping/subsidy and injury.

4. If none of domestic industrial representatives (individuals or organizations) apply for the expiry reviews as regulated herein and the MOFCOM fails to initiate the expiry reviews before expiring dates, the antidumping or anti-subsidy measures will cease on respective expiring dates.
