MOFCOM Announcement 101, 2010 on Anti-Dumping Duties on PBT Resins

On July 22, 2006, the P. R. China's Ministry of Commerce (MOFCOM) issued its Announcement No. 42, 2006 to levy anti-dumping duties on imported PBT resins originating in Japan and Taiwan region, effective from July 22, 2006 till July 22, 2011.

According to Article 48 in the Anti-Dumping Regulations of the P. R. China, anti-dumping duties may be prolonged to some extent where anti-dumping termination, after being reviewed, is probable to cause the persistence or reoccurrence of any dumping and injury.

From the issue date of this Announcement, related domestic industries or their representative natural persons, legal persons or organizations may file a written application to the MOFCOM for final-term anti-dumping review within 60 days before the expiry date of such an anti-dumping measure.

Their application shall contain explicit representation for the final-term review and adequate evidence that anti-dumping termination is probable to cause the persistence or reoccurrence of the dumping and injury.

The anti-dumping measure above mentioned may cease from force as from July 22, 2011, in case that related domestic industries or representative natural persons, legal persons or organizations make no application nor the MOFCOM conducts proactive investigation for the anti-dumping review before the expiry date thereof.
