The U.S. Initial Anti-Circumvention Ruling on China-Made Graphite Electrodes

Recently, the U.S. Department of Commerce made a preliminary ruling for anti-circumvention on small-diameter graphite electrodes, holding that the subject products made in China have circumvented the U.S. antidumping duty order issued on February 26, 2009 by means of exporting from the U.K.

The U.S. petitioner SGL Garbon company charges U.K. company Superior Graphite with circumvention of U.S. antidumping on the Chinese products by importing them from China for simple assembly and then exporting to the U.S.

The U.S. Department of Commerce instituted an anti-circumvention probe on March 18, 2011 for this case.

The Department launched the antidumping probe into the Chinese products on February 6, 2008 and issued an antidumping duty order in February 2009 specifying the rate of 132.9%-159.64%.
